1. Overview. Zuzula.com ("Zuzula" or "we") is committed to protecting the privacy of your personal information. This Privacy Policy sets forth the manner in which Zuzula uses any information you provide to us. The information that we request from you is designed to enable us to improve your experience with this application (the "Application"). Upon downloading the Application, you will be asked to register as a user by providing your name, credit card and billing information, email address, password, user name, connection speed, zip code, age group and gender.
2. Personally Identifiable Information. We will not sell, rent or otherwise distribute your personally identifiable information to any third parties without your consent, unless we are required to do so by law, except: (i) in the event you access or download the Application (including any co-branded version thereof) through a website owned or controlled by a party other than Zuzula (a "Distribution or Syndication Partner"), in which case we may provide the information we collect to such Distribution or Syndication Partner, (ii) in the event of a change of control associated with the sale, merger, transfer, or other disposition of all or a portion of the business of Zuzula.com and/or its subsidiaries, in which case the new controlling party shall receive the information we collect, and (iii) solely to enable our third-party billing service to develop and maintain our billing software.
We may use the personally identifiable information we collect from you for the following purposes: (a) to send you notices related to your account and necessary product updates; (b) to send you news, updates and special offers from us and our partners, only if you request to receive them (you may remove yourself from this list at any time by going to the Member Info button on the Application and selecting the appropriate link under Account Management.); (c) to send you our free newsletter, if you request to receive it (you may unsubscribe to the newsletter at any time by following the instructions provided in each issue or by going to the Member Info button and selecting the appropriate link under Account Management); (d) if you purchase any of our songs, to process your order and charge your account for the song(s) you purchase, your credit card number is submitted to the credit institution for normal, routine processing. We do not share credit history or credit card numbers with other companies or third parties.
3. Children Under 13 Years Of Age. If a user indicates in the registration process that he or she is under thirteen (13) years of age, then we will store only the following personal information for such user: user name, password, and email address. We will require the child to give us the email address of a parent or guardian, and we will notify the parent or guardian via email of the child's registration for the Application and their provision of personal information. We will provide the parent or guardian with an opportunity to request the deletion of the child's personal information from our system. We will also provide the parent or guardian with e-mail confirmation of such deletion.
We will only use the personal information of children under the age of thirteen (13) for the following purposes: (i) to maintain their user accounts, (ii) to send them essential account and product information, and (iii) if the child opts in, we will send the child our product updates and newsletter. We will not knowingly disclose personal information about users under the age of thirteen (13) without prior parental consent, except as required by law. If for any reason you wish to access, update or remove information about your child that has been previously provided to us, please notify us at accounts@zuzula.com.
We strongly recommend parental supervision when a child uses the Internet, particularly when a child enters a discussion forum or uses email. We also encourage parents to instruct their children not to give out personal information in discussion forums or in email.
4. Non-Personally Identifiable And Aggregate Information. The non-personally identifiable information we gather on our registration form includes your gender, age group, and zip code. We also gather anonymous data related to the pages and items that are viewed, clicked on, streamed, burned and searched for, and the URLs that users may click on from the Application.
Zuzula uses this information only in aggregate form to understand how users are using the Application so that we can improve it and make your experience using the Application and the Subscription Services as useful as possible. We will occasionally release aggregate demographic information about user trends to partners and other third parties, including third-party advertisers on the Application. An example of this type of information would be patterns of use of the Application based on zip code or age group. We also retain aggregated log files of requested content in order to report overall product usage to content partners and to evaluate user trends.
What About Cookies?
To enhance your experience while using Zuzula, we use a feature on your Internet browser called a "cookie." Cookies are small files that are sent to your web browser, that your web browser then places on your computer's hard drive. We use cookies to recognize your browser, store your user name and enable you to automatically log in to the Application and any Subscription Service from your computer without entering your user name each time. We will always ask for your password before allowing you to view or change any personal information stored in connection with your account. We also use cookies to better personalize the specific banners and promotions that you will see when you are using the Application. Some of the advertising served through the Application is supplied by one or more third parties which may also use cookies. If you are uncomfortable with cookie technology you may change the settings on your browser to disable cookies.
What About IP Address?
We also store your IP address. IP addresses are used by your computer every time you are connected to the Internet. Your IP address is a number that is used by computers on the network to identify your computer so that data (such as the web pages you request) can be sent to you. From time to time, we may use information derived from your IP address to deliver you appropriate products, services and software.
Third Party Advertising
We may use third-party advertising companies to sell, serve and manage the banner ads served through the Application. These companies may use information (not including your name or email address) about your use of the Application and other web sites in order to provide ads through the Application and on other web sites about goods and services that might be of interest to you.
Third Party Websites Please note that Zuzula does not control the policies and practices of our advertisers or of web sites to which the Application may link (other than Zuzula). If you have questions about these parties' use of information they may gather from you when you click on their ads or go to their web site, please contact them directly.
5. Promotions And Sweepstakes. If you chose to enter a promotion, sweepstakes, or contest hosted by Zuzula or sponsored by Zuzula and/or one of our partners, we may ask for your name, address, and email address. You may be asked to provide additional information or to answer certain questions, some of which may be optional, in order to participate. We may contact you in connection with a particular promotion, such as a sweepstakes or contest, in order to update you of your status, administer the promotion, let you know that a promotion has ended, and for other purposes.
Promotions that are hosted on Zuzula may be sponsored by Zuzula, may be co-sponsored by Zuzula and another company, or may be sponsored by companies other than Zuzula. Some or all of the data collected during a promotion may be shared with the sponsor(s) or companies indicated on the entry form. If data will be shared, then there will be notice prior to the time of data collection or transfer.
6. Security. All personal information is stored in our secure databases. Access to that information is strictly controlled and limited to certain Zuzula employees and contractors on a need-to-know basis. We want to protect the integrity of your personal information that we may have in our database. Zuzula maintains controls to provide security over personal information, including credit card details, during and after the purchase process. The controls include:
o The use of secure connections from the customer's Web browser to Zuzula
o The use of encryption for sensitive personal information, such as credit card numbers
o The logical security of the databases that store customers' credit card numbers
o Security controls to restrict access to databases housing personally identifiable information
o Quality assurance procedures during product development requiring that new and upgraded products be specifically tested to ensure that they do not contradict or violate this Privacy Policy
7. Reviewing And Updating Your Information. You can easily review and update your Account Information by going to the Member Info button on the Application and selecting the appropriate link under Account Management. 8. Deactivation Membership. Users may request that their Zuzula membership be canceled by sending an email to accounts@zuzula.com with the subject header: Deactivate Membership. Zuzula will delete your Account Information, including all of your personal information, within one week after your membership is canceled.
9. Reasonable Efforts. We will use reasonable efforts to comply with this privacy policy and will take prompt corrective action when we learn of any failure to comply with our privacy policy. We sometimes release beta versions of our products, which are further refined before the release of the final version. Because these products are still in a test phase, we may not always catch an unintended privacy issue, despite our efforts to do so. As such, we welcome user feedback on any privacy concerns you may have. In light of the above and because of the complex and constantly changing nature of our technology and business, Zuzula does not guarantee error-free performance under this privacy policy. Zuzula shall not be liable for any incidental, consequential or punitive damages relating to this privacy policy.
10. Changes To Our Privacy Policy. If we decide to change our privacy policy, we will post any changes here so that you will always know what information we gather, how we might use that information and whether we will disclose it to any third parties. We will also use reasonable efforts to notify you of any material changes at any email address you provide to us.
11. Your Consent To Use Information. By using the Application, you consent to the collection and use of this information as described herein.
